Marco R. Provvidera practices law in New York City and is qualified in Italy. He is a member of the New York State Bar and of the Italian Bar; He is also admitted to practice before the U.S. District Court for the Southern District of New York, the U.S. Court of Appeals for the Federal Circuit, Washington, DC, and the U.S. Court of International Trade, New York.

 

            After his JD at University of Rome’s “La Sapienza” Law School, Marco earned an LL.M in Anglo-American and Comparative Law at New York University School of Law. He also earned a MBA-curriculum Diploma in American Management Studies, focused on corporate and international finance, at the European University, San Francisco, CA. He is fluent in English, French, Italian, and intermediate-level in Spanish.

 

With a solid background and substantial experience in both the common-law- and the civil-law-based legal systems, his practice currently focuses on: General Corporate; Commercial Contracts; Technology Contracts; International Trade; Real Estate Funds and Investment-Vehicle Structuring; Domestic and Cross-Border Litigation and Arbitration; Internet Law; Software Products and Licensing-related issues; ISPs Liability; IP Rights Protection and Enforcement; Privacy and IT Security; Entertainment and Film Industry; Selected areas of EU Law.

 

He joined, since inception, Partnership for Growth, a professional network established by the US Embassy to Italy, which promotes in-depth understanding of multi-jurisdictional issues in the areas of cross-border investments and IP rights protection, and aims at enhancing the business cooperation between the US and Italy. He is also a member of BAIA (Business Association Italy America), which focuses on bridging the gap for IT companies aiming at expanding venture capital operations in both countries.

 

            Marco is Sector Director for Global Legal Issues at the Italian Institute for Privacy, a think-tank of top privacy experts in Italy and Europe, and Member of the Scientific Board of the European Privacy Association, a privacy advocacy group working in close cooperation with the EU institutions in Brussels, of the Advisory Board of a leading Italian IT security law publication (Sicurezza Digitale), and the International Legal Experts Panel of the John Hopkins University “International Journal of Digital Investigations”.

 

            His recent speaking engagements include: IT industry international workshop on “Data Breach: Legal and Managerial Issues”, focusing on US Serbanes-Oaxley v. EU privacy issues, Rome, 2008; American Bar Association, Section of International Law Fall Meeting, Brussels, 2008; ABA SIL Fall Meeting, Paris, 2010, where his two contributions covered the on-going US/EU debate on: a) Third-party funding litigation, and, b) ISPs’ liability, in a cross-border perspective, with reference to recent headline-making court decisions in the global arena – YouTube in New York, Google in Italy, Hadopi in France, and others. 

 

Marco is a member of the American Bar Association, Section of International Law and Section of Business Law, and is active in a number of standing Committees of both Sections; Recent leadership responsibilities include his re-appointing, by the Section of International Law, as Co-Chair of the International Intellectual Property Rights Committee for the third term in a row (August ’12 – August ’13), and appointed him as Vice-Chair of the Information Services, Technology and Data Protection Committee, and as a member of the Private International Law Committee’s Steering Group. 

 

Marco is also a member of the Law Society of England and Wales, International Division, and of the International Bar Association, European Forum, North America Forum, Forum for Barristers and Advocates, Corporate Law Section’s Corporate and M&A Law Committee, Dispute Resolution Section’s Litigation Committee.

 

He is a regular speaker at global professional meetings/events, and a contributor to professional newsletters and legal/financial publications on international business issues, privacy, IP rights; among his latest works, various articles published on: ABA newsletters; Bancaria (monthly publication of the Italian Banking Association); Il Sole 24-Ore (Italian financial daily); Published contributions to four EU Commission's Calls for Public Consultations: “Advanced Technologies Legal Framework”, Dec., 2009; “EU-US Treaty on Law Enforcement. Legal Issues on Privacy”, March, 2010; “E-Commerce Directive”, July, 2010; “Data Protection Directive”, January, 2011. He also provided comments, as EPA Scientific Committee, in response to the last EU Public Consultation, “Enforcement of Intellectual Property Rights”, March, 2011.  As a co-author of “Next Privacy”, a collection of eight academic-level essays, published in Italy, March, 2010, and currently being translated into English, he wrote about the comparative constitutional issues, in the U.S., U.K., E.U. legal systems, related to international privacy and global security.
